Article 1 – Definitions
In these terms and conditions, the following definitions apply:

Cooling-off period: the period during which the consumer may exercise the right of withdrawal.

Consumer: the natural person who does not act in the course of a profession or business and who enters into a distance contract with the trader.

Day: calendar day.

Ongoing transaction: a distance contract relating to a series of products and/or services, the supply and/or purchase of which is spread over time.

Durable medium: any tool that enables the consumer or trader to store information addressed personally to them in a way that allows future consultation and unaltered reproduction.

Right of withdrawal: the option for the consumer to withdraw from the distance contract within the cooling-off period.

Trader: the natural or legal person offering products and/or services to consumers at a distance.

Distance contract: a contract concluded between the trader and the consumer in the context of an organised system for distance selling, without simultaneous physical presence.

Means of distance communication: tools used to conclude a contract without the physical presence of both parties in the same place.

General Terms and Conditions: the current terms and conditions of the trader.

Article 3 – Applicability
These terms and conditions apply to every offer by the trader and to every distance contract and order concluded between the trader and the consumer. Before the distance contract is concluded, the text of these terms and conditions will be made available to the consumer.
If the contract is concluded electronically, the terms may also be provided in such a way that the consumer can easily store them on a durable medium.
In case of additional product- or service-specific terms, the most favourable provision for the consumer shall prevail in case of conflict.
If any part of these conditions is null or void, the remaining provisions remain in force.
Article 4 – The Offer
Offers are non-binding and subject to availability. Obvious mistakes or errors do not bind the trader.
Offers will clearly state:

The total price (excluding customs clearance and UK import VAT, which are the buyer’s responsibility).

Any applicable shipping costs.

How the contract will be concluded.

Whether the right of withdrawal applies.

Accepted payment methods.

Delivery timelines and terms.
For UK customers, customs and import VAT may be collected by the courier upon delivery. The trader does not charge VAT for orders delivered outside the EU.
Article 5 – The Contract
The contract is concluded when the consumer accepts the offer and meets the associated conditions. Acceptance electronically will be confirmed immediately by the trader. The trader may investigate the consumer’s ability to meet payment obligations.
With the product, the trader will include:

The company’s physical address.

Details on the right of withdrawal (if applicable).

Information on after-sales service and warranties.
Article 6 – Right of Withdrawal
Consumers may cancel purchases within 14 days of delivery without giving a reason. During this period, the consumer must handle the product and packaging with care.
The consumer must notify the trader of the return within 14 days and return the product within 14 days after notification. Proof of return must be provided.
Article 7 – Return Costs
Return shipping costs are the responsibility of the consumer. Refunds will be processed within 14 days of notification, provided the returned goods are received in good condition.
Article 8 – Exclusion of the Right of Withdrawal
The right of withdrawal may not apply to:

Custom-made or personalised products.

Perishable goods.
-
Sealed hygiene products, if opened.

Digital content not supplied on a tangible medium.
Clear notice will be provided if the right of withdrawal does not apply.
Article 9 – Pricing
Prices will not increase during the validity of the offer, except for changes due to VAT legislation.
For UK customers, no VAT is charged by the trader. Import VAT and customs charges may be collected by the courier.
All prices are subject to printing and typographical errors. No rights can be derived from erroneous prices.
Article 10 – Conformity and Warranty
Products must meet the contract specifications. Defective or incorrect items must be reported within 14 days.
Warranty covers manufacturer defects but excludes misuse or unauthorised modifications.
Article 11 – Delivery and Fulfilment
The trader will ship accepted orders as soon as possible and at the latest within 30 days, unless agreed otherwise.
If delivery is delayed, the consumer has the right to cancel and receive a full refund within 14 days.
The risk of damage or loss remains with the trader until the product is delivered.
Article 12 – Subscriptions
Consumers may cancel ongoing or automatically renewing subscriptions with a notice period of up to one month.
Fixed-term contracts are not automatically renewed unless stated clearly.
Article 13 – Payment
Payments must be made within 7 business days unless agreed otherwise.
Errors in payment details must be reported immediately. In case of late payment, the trader may charge reasonable recovery costs.
Article 14 – Complaints Procedure
Complaints must be submitted within 7 days of discovering the issue.
The trader will respond within 14 days. If a longer period is needed, the consumer will be notified.
If a dispute arises, parties may seek dispute resolution.
Article 15 – Disputes
Contracts between the trader and consumer are governed by UK law, even if the consumer resides outside the UK.
Article 16 – CESOP Compliance
In accordance with recent EU legislation (CESOP), payment service providers may report certain transactions to a European central payment database. While this does not directly affect consumers, Siviyo-Birmingham complies with applicable data-sharing obligations for cross-border payments.
